Conditions of Attendance & Assumption of Risk

When you register for the Short Shake Sessions, you agree to participate in an activity that might feel physically, emotionally, and/or psychologically activating. Such experiences always involve a certain amount of risk. In a group setting, the facilitator cannot always monitor your physical, emotional, and psychological limits, and your registration demonstrates your consent to take responsibility for assessing the risk any activity poses to you and choosing a safe course of action for yourself.

With your registration, you affirm that you assume the risk and responsibility for any physical or emotional injuries or damages suffered by you arising out of your participation in the Short Shake Sessions.

Recordings of you: The Short Shake Sessions will not be recorded.

Photographs of you and/or your artwork: When you attend the Short Shake Sessions, the facilitator may ask to take a screenshot of you and/or your artwork. Photographing your artwork does not imply a judgment on its value, good or bad. Often people are simply more relaxed and inspired to participate when they see a wide variety of images. If you are not comfortable having your paintings photographed and shared, you always have the right and freedom to decline. The facilitator will always ask prior to taking a photo, and you can

•  Inform the facilitator that you don’t want your artwork to be photographed.

•  Ask me to remove an image of your painting that you previously agreed to that appears on the website or in a social media feed over which we have control.

Screenshots may be used for promotional, educational, or informational purposes and may appear in the following places:

•  a secure attendance log of session participants

•  this website

•  social media feeds

•  electronic newsletters, or

•  other electronic or printed communications.

When you consent to have your photo taken, you agree that it may appear for the purposes and in the locations listed in the section above, without attribution and without compensation to you of any kind.

Your Own Photography and Recording Devices during the Sessions
Personal audio or video recording devices are not allowed during any session.

Uncensored Visual Expression
When you participate in Short Shake Sessions, I will not censor your art process. Each participant has full permission to create whatever images naturally arise for them. That means you may see images that contain nudity, sexuality, or violence. You are just as likely to see flowers, hearts, animals, and polka dots. It’s all allowed. For this reason, please assess your own needs in this regard and contact us if you have questions before registering for a program.

I’m under no obligation to screen or monitor your posts. However, I do ask that comments stay on topic, are courteous, and remain free of offensive comments. Your posts may not:

•  contain any materials -- such as photographs, artworks, or writing -- that violate a third-party’s copyright or other intellectual property rights

•  contain sexually explicit, graphic, gratuitous or unnecessarily violent content or defamatory or derogatory content against any ethnic, racial, gender, religious, sexual orientation, professional, or age group, or contain any pornographic material

•  contain any private information or photos of or about another individual

•  contain any software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment

•  contain any advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or

•  promote illegal activity or illegal contests, sweepstakes, or gambling, including any online casino, sports books, bingo, poker, or any other form of solicitation.

I reserve the right to edit comments for content, remove off-topic contributions, delete offensive comments or remarks, block offensive contributors, and delete actual or suspected spam content from any social media site. In keeping with the spirit of the Short Shake Sessions, I may delete comments that make value judgments on images posted to the social media feed. In addition, I will delete all comments or posts intended to promote product-based artworks, sales, shows, galleries, contests, and similar product-based painting ventures.

Once you post something online, it lives there —anyone can read your words even years from now. Please be cautious when posting and refrain from disclosing personally identifiable information, such as your location or other sensitive information. I am not responsible for the content of any comments or responses posted by others to any website or social media site managed or monitored by the Short Shake Sessions. I do not control the placement of any marketing or advertising displayed on our pages by social media or third party organizations. The inclusion of links to other websites does not imply any endorsement of the material on the websites.

I reserve the right to respond to any post or comment and may occasionally privately request your contact information to assist you offline with your consent.

Privacy Policy

I don’t sell or rent your personal information to anyone.

If I ever become famous or grow tired of hostessing the Short Shake Sessions, I may transfer the Short Shake Sessions to another individual or organization, so the (p)arty can carry on. In that event, I would transfer or disclose your personal information to the acquiring organization. The acquiring organization may collect, use and disclose such information to evaluate the proposed transaction or to operate and manage the affairs of the acquired nonprofit assets, or for other purposes identified in this policy.

The website may sometimes include third-party advertising and links to other websites. I do not provide any personally identifiable customer information to these advertisers or to third-party websites, other than those owned by Amy Ponteri, LPC, LCAT, ATR-BC with your prior consent.

I have no control over the privacy practices of sites outside our domain. If you follow a link to another website, please read that site’s privacy policy.

Finally, I reserve the right to disclose your personal information as required by law, and as necessary to protect the property, interests and rights of the Short Shake Sessions and Amy Ponteri, LPC, LCAT, ATR-BC.

How Information is Collected from You
The Short Shake Sessions keeps and has access to only the personal information that you voluntarily give when you:

•  connect with us by phone, email, or a form on this website

•  register for a session

•  interact with the website

•  subscribe or request to receive the newsletter, or

•  respond to a survey or other direct request for information.

 What Information I Collect From You
I collect only the information from you that is necessary to carry out my business and to provide the services, products, and information you request. The personal information I collect as a result of your interactions with me may include your:

•  billing address

•  phone number(s)

•  names and information of others for whom you have made purchases

•  payment (we don’t store your credit card information; see below), or

•  opinions or preferences when you communicate with me

The Short Shake Sessions may also gather anonymous data from your use on the website, such as browser information, Internet Service Provider (ISP), operating system, Internet Protocol (IP) addresses or other device identifiers, location and date/time stamp.

-       to provide you with information about upcoming programs and new projects

How Long I Keep Your Information
I keep your personal information only as long as is reasonably necessary for the purposes described in this policy or any period required by applicable law.

Your Access to and Control Over Information

  • find out what information I have about you, if any

  • change or correct any information I have about you

  • ask me to erase any information I have about you

  • opt out of future contacts, or

  • express any concerns you have about the use of your information.

I may ask you to verify your identity before we take action on your request. I will process your request within 30 days of receiving it.

If you ask us to erase your personal information, please note that we may keep certain information as required by law or for legitimate business purposes. If I have shared your personal information with others, I will let them know about the erasure, if possible.

To inform you and promote other programs. If I have your consent, I will communicate with you via email or direct mail to provide you with promotional materials and information regarding other programs, products, promotions, special offers, and surveys. I share your personal information with MailChimp, an email marketing service that helps me deliver email marketing campaigns to you. As provided below, you may always choose to unsubscribe at any time.

For legitimate business interests. To improve your experience, I may use your personal information to:

  • help you access and use the website

  • send you service or support messages and updates

  • operate, protect, improve and optimize the website and your registration or purchasing experience—for example, by performing analytics to help improve customer service and assessing my performance to improve offerings

To meet our legal obligations and protect legal rights. When the law requires, or when I believe it is necessary to protect our legal rights, interests, and interests of others, I may use personal information in connection with legal claims and compliance and for regulatory and audit purposes.

When your personal information is anonymous, I do not require a legal basis to use it, because the information does not constitute personal information under applicable data protection laws. My use of anonymized or de-identified data is not subject to this policy.

When I Share Your Information with Third Parties
To collect payment: 
When you register for the Short Shake Sessions, I share your payment details with credit card companies and other payment providers. The Short Shake Sessions do not store any payment card numbers after your transaction is complete.

When there is a guest facilitator: From time to time, I may have a guest facilitator. They will be responsible for facilitating the Short Shake Sessions and have access to your registration details and to communicate with you (via email, chat, phone, Zoom) to ensure your registration and participation.

With your direct consent, I may share your personal information with guest facilitators, so that they can provide you with information about their own services, projects, and offers that may be of interest to you. For example, you may agree to be added to a guest facilitator’s separate mailing list.

Any third parties are prohibited from using or disclosing your personal information for any reason other than processing. They must also use security safeguards appropriate to the sensitivity of your information.

Website Privacy
How Cookies Are Used (These ain’t your grandma’s cookies.)
A “cookie” is a piece of information that a website can send to your computer’s hard drive while you are using the website. The Short Shake Sessions use temporary cookies. These pieces of information allow the website to remember information that will make your future visits to the website more efficient. I do not link the information we store in cookies to any personally identifiable information you submit while on our site.

Cookies may store a variety of information, including the number of times you visit a website and the number of times you view a particular page on a website. Our privacy policy does not cover the use of cookies by our facilitators’ separately owned websites, tracking utility company, or service providers. I do not have access or control over these cookies. If you have concerns, please contact that provider directly.

How Files Are Logged
Like most websites, certain information is automatically gathered and stored in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. I use this information, which does not identify individual users, to analyze trends, to administer the website, to track users’ movements around the website, and to gather demographic information about the user base as a whole.

Social Media Widgets
The website includes social media features—for example, the Instagram button that you see on the website. This feature may collect your IP address, which page you are visiting on our website, and may set a cookie to enable the feature to function properly. The social media features and widgets are hosted by third parties. Your interactions with a social media feature is governed by the privacy policy of the company that provides it.

Security
This website has security measures in place to protect the loss, misuse, or alteration of the information under our control. In particular, all credit card and other transactional information is transmitted using Secure Sockets Layer (SSL) technology—the industry standard for protected credit card transactions. You can verify this by looking for a closed lock icon at the bottom of your web browser or looking for “https” at the beginning of the address of the web page.

Children and Minors
This website is not intended for use by people under the age of 18. I cannot prohibit minors from visiting this website and rely on parents and guardians to decide which materials are appropriate for children.

I will not intentionally collect any personal information from people under the age of 18 through this website. If you think that I have collected personal information from a person under the age of 18 through this website, please contact us. If I learn that we have collected information from a person under the age of 18, we will promptly delete it.

Our policy regarding children and minors is intended to satisfy the requirements of the Children's Online Privacy Protection Act and Privacy Rights for California Minors in the Digital World.

International Users
My business is based in the United States. No matter where you are located, information you provide to us or that we obtain when you use our websites will be subject to U.S. law, which may differ from the laws of the country where you live. When you use the website or provide your information to us, you consent to the collection, transfer, storage, and processing of information to and in the United States.

Do Not Track
I do not currently honor "Do Not Track" browser signals or mechanisms that indicate a request to disable online tracking of individual users who use our website.

Generally, I use tracking technology to remember you when you return to our website, to understand and analyze anonymous usage trends, and to learn about visitor behavior on our website so that we can improve what we offer to you.

Legal Disclaimer
We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our legal rights or to comply with a judicial proceeding, court order, or legal process served on The Painting Experience or The Institute for Art and Living.
